Insurance Waiver

In consideration of being allowed to participate in any way in the Willow Creek 1 Barracudas Swim Team program, its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that:

1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce the risk, the risk of serious injury does exist; and,

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES of others, and assume full responsibility for my participation; and,

3. I willingly agree to comply with the stated and customary terms and conditions for participants. If, however, I observe any unusual significant hazard during my presence or participating, I will remove myself from participating and bring such to the attention of the team and league officials immediately; and,

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE Willow Creek 1 Barracudas Swim Team, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and leasers of premises used for the activity (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the full extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by the law.

Code of Conduct

WC1 Barracudas adhere to the Mountain Hi Swim League (MHSL) Code of Conduct - replicated here from from MHSL Processes & Procedures:

36. Code of Conduct

36.1. Mountain Hi Swim League believes in the development of swimmers both athletically and individually. Mountain Hi Swim League will strive to instill and practice the values of good sportsmanship. In order to achieve these goals, it takes a combination of coaches and parents to set good examples for the swimmers. Mountain Hi Swim League has established and will enforce the following conduct guidelines:

36.2. Courtesy, Goodwill, and Sportsmanship: Any parent, swimmer, or other individual acting as an agent, member, Delegate, volunteer, coach, participant, or spectator of either the member teams or the Mountain High Swim League shall behave in a manner that displays mutual regard and respect for others and shall refrain from foul or derogatory behavior. Such behavior includes activity at any and all gatherings and/ or correspondence (electronic or otherwise) that may fall under the jurisdiction of the League.

36.3. Personal conduct of team members, parents and guests at all meets is the responsibility of the Parent Delegate of each team.

36.4. The Parent Delegates from the home and visiting team should act as CoMarshals at a dual meet. The marshal(s) shall have full authority to warn or order to cease and desist and, with the concurrence of the Referee, to remove or have removed from the swimming venue anyone behaving in an unsafe manner or using profane or abusive language, or whose actions are disrupting the orderly conduct of the meet.

36.5. At Preliminary and Finals Sessions of Division Championship meets, the Division Vice President shall act as Marshal. The marshal(s) shall have full authority to warn or order to cease and desist and, with the concurrence of the Referee, to remove or have removed from the swimming venue anyone behaving in an unsafe manner or using profane or abusive language or whose actions are disrupting the orderly conduct of the meet.

36.6. At the All Stars Meet, the President, President Elect, Secretary, Treasurer, and/ or Past President shall act in conjunction with the League Delegate of the host team as Co-Marshal. The marshal(s) shall have full authority to warn or order to cease and desist and, with the concurrence of the Referee, to remove or have removed from the swimming venue anyone behaving in an unsafe manner or using profane or abusive language or whose actions are disrupting the orderly conduct of the meet.

36.7. All swimmers, coaches, parents, and spectators should only make remarks in the spirit of friendship and good sportsmanship.

36.8. All swimmers, coaches, parents, and spectators should refrain from using foul language or obscene gestures.

36.9. All swimmers, coaches, parents, and spectators should applaud the other team’s performance. Competitors should shake hands of the swimmers in the lanes next to them at the end of their race.

36.10. All swimmers, coaches, parents, and spectators should follow all rules of the hosting pool.

36.11. All swimmers, coaches, parents, or spectators must not introduce any items into the pool including any item that could cause any chemical imbalance in the pool such as Jell-O.

36.12. All swimmers, coaches, parents, and spectators should cooperate with and accept the final decisions of the Stroke & Turn Judge, Starter and Meet Referee.

36.13. All swimmers, coaches, parents, and spectators must refrain from addressing derogatory remarks to any coach, swimmer, Stroke & Turn Judge, parent, Timer, Starter, Meet Referee or any other volunteer.

36.14. All coaches must use proper protest procedures.

36.15. All coaches must require positive conduct from his/her swimmers.

36.16. All coaches, parents, and spectators should always remember that MHSL exists for the positive experience of the swimmer.

36.17. All parents should respect the coach’s decisions and abilities, except in the case where it may cause injury to the team or swimmer.

36.18. Unsportsmanlike conduct will not be tolerated.

36.19. Cooperation at all levels is expected from all involved participants to come to reasonable and equitable solutions to disagreements or disputes as they arise.

36.20. Any infraction or inappropriate behavior should be submitted to the Grievance Committee. Upon recommendation from the Grievance Committee, the Board will take the appropriate action.

36.21. TOBACCO PRODUCTS — Smoking and use of other tobacco products is prohibited on the pool deck, in the locker rooms, in spectator seating or standing areas, and in all areas used by swimmers, during the meet or during the warm-up periods in connection with the meet.

36.22. ALCOHOLIC BEVERAGES — Alcoholic beverages are prohibited in all areas of the venue, including, but not limited to, pool deck, locker rooms, spectator seating or standing areas, and in all areas used by swimmers. Exceptions to this provision can be made only with the approval of the MHSL Board of Directors.

Media and Team Directory Release Waiver

I hereby authorize Willow Creek 1 Barracudas Swim Team program to publish the photographs taken of me and/or the minor children registered here, and our names, for use in the Willow Creek 1 Barracudas Swim Team program to include printed publications and website. I release Willow Creek 1 Barracudas Swim Team program from any expectation of confidentiality for the undersigned minor children and myself and attest that I am the parent or legal guardian of the children registered here and that I have the authority to authorize Willow Creek 1 Barracudas Swim Team program to use their photographs and names. I acknowledge that since participation in publications and websites produced by Willow Creek 1 Barracudas Swim Team program is voluntary, neither the minor children nor I will receive financial compensation. I further agree that participation in any publication and website produced by the Willow Creek 1 Barracudas Swim Team program confers no rights of ownership whatsoever. I release the Willow Creek 1 Barracudas Swim Team program, its officers, directors, and coaches from liability for any claims by me or any third party in connection with my participation or the participation of the registered minor children.

I authorize Willow Creek 1 Barracudas Swim Team program to publish our contact information in a team directory.

COVID-19 Waiver 2021

IN CONSIDERATION for myself and/or my children listed above being permitted to utilize the services, utilize the facilities and/or participate in the swim program of the Willow Creek 1 Barracudas, a Colorado nonprofit corporation, (the “Barracudas”), including, but not limited to, observation or use of facilities or equipment, or participation in or acting as a spectator during any program affiliated with the Barracudas. The undersigned, on behalf of himself or herself and such participating children and any personal representatives, heirs, and assigns (hereinafter referred to as "the undersigned") hereby acknowledges, agrees and represents that he or she has inspected and carefully considered such premises, equipment, and facilities and has considered the Barracudas programs and that the undersigned finds and accepts same as being sufficiently safe and reasonably suited for the use or participation by the undersigned and such participating children.

In addition, the undersigned acknowledges that novel coronavirus (''COVID-19") infections have been confirmed throughout the United States, including multiple cases in Colorado and the undersigned’s locality. In accordance with the most recent guidance and recommendations issued by the World Health Organization (WHO), the Centers for Disease Control and Prevention (CDC), Colorado Department of Public Health and Environment for slowing the transmission of COVID-19, the undersigned hereby agrees, represents, and warrants that neither the undersigned nor such participating children shall visit or utilize the facilities, services, and/or programs of the Barracudas within 14 days after (i) returning from highly impacted areas subject to a CDC Level 3 Travel Health Notice, (ii) exposure to any person returning from areas subject to a CDC Level 3 Travel Health Notice, or (iii) exposure to any person who has a suspected or confirmed case of COVID-19. The undersigned hereby agrees, represents, and warrants that neither the undersigned nor such participating children shall participate in, visit or utilize the facilities, services, and/or programs of the Barracudas if he or she (i) experiences symptoms of COVID- 19, including, without limitation, fever, cough, loss of sense of taste or smell, or shortness of breath, or (ii) has a suspected or diagnosed/confirmed case of COVID-19. The undersigned agrees to notify the Barracudas immediately if he or she believes that any of the foregoing access/use restrictions may apply.

The Barracudas have taken certain steps to implement certain recommended guidance and recommendations issued by public health agencies for slowing the transmission of COVID-19, including, without limitation, the access/use restrictions set forth above. The undersigned acknowledges and agrees that the Barracudas may revise its procedures at any time based on updated recommended guidance and recommendations issued by public health agencies and further agrees to comply with the Barracudas revised procedures prior to utilizing the facilities, services, and/or prior to participating in the programs of the Barracudas. The undersigned further acknowledges and agrees that, due to the nature of the facilities, services, and programs offered by the Barracudas, social distancing of 6 feet per person among children and their fellow participants or others is not always possible. The undersigned fullyunderstands and appreciates both the known and potential dangers of participating in the programs and/or utilizing the facilities and services of the Barracudas and acknowledges that use thereof by the undersigned and/or such participating children may, despite the Barracudas prudent and reasonable efforts to mitigate such dangers, result in exposure to COVID-19, which could result in quarantine requirements, serious illness, disability, and/or death.

IN FURTHER CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE BARRCUDAS PROGRAMS, THE UNDERSIGNED HEREBY AGREES TO THE FOLLOWING:

THE UNDERSIGNED, ON HIS OR HER BEHALF AND ON BEHALF OF SUCH PARTICIPATING CHILDREN, HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE the Barracudas, or any of its directors, officers, employees, volunteers and agents, or any of the fellow participants or their family members or guests from all liability to the undersigned or such participating children and all personal representatives, assigns, heirs, and assigns of the undersigned or such participating children for any loss or damage, and any claim or demands on account of any property damage or any injury to, or an illness or the death of, the undersigned or such participating children (or any person who may contract COVID- 19, directly or indirectly, from the undersigned or such participating children) whether caused by the negligence, active or passive, of the Barracudas or otherwise while the undersigned or such participating children are in, upon, or about the premises or any facilities or using any equipment of or participating in any program of or affiliated with the Barracudas.

THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY, DEFEND AND HOLD HARMLESS the Barracudas, its directors, officers, employees, volunteers and agents, and each of them, from any loss, liability, damages or costs they may incur, whether caused by the Barracudas negligence, active or passive, or otherwise while the undersigned or any participating child is participating in any program of the Barracudas or in, upon, or about the premises or any facilities or equipment affiliated with the Barracudas.

The undersigned agrees and acknowledges that use of the Barracudas facilities and services, and participation in the Barracudas swim program, may involve inherent danger and risk, including, without limitation, the risk of physical illness or injury, death or property damage. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR, AND RISK OF ILLNESS, BODILY INJURY, DEATH OR PROPERTY DAMAGE to the undersigned or such participating children due to negligence, active or passive, or otherwise while in, about or upon the premises of the Barracudas swim program sites and/or while using the premises or any facilities or equipment thereon and/or while participating in or observing any program affiliated with the Barracudas. The undersigned acknowledges that any illness or injuries that the undersigned or such participating children contract or sustain may be compounded by negligent first aid or emergency response of the Released parties and waives any claim in respect thereof.

THE UNDERSIGNED further expressly agrees that the foregoing ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of Colorado and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS OR INDUCEMENT APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE. I AM AWARE THAT BY AGREEING TO THIS AGREEMENT I AM GIVING UP VALUABLE LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES FROM THE BARRACUDAS IN CASE OF ILLNESS, INJURY, DEATH OR PROPERTY LOSS OR DAMAGE, INCLUDING, FOR THE AVOIDANCE OF DOUBT AND WITHOUT LIMITATION, EXPOSURE TO COVID-19 AT ANY BARRACUDAS FACILITY OR DURING PARTICIPATION IN ANY PROGRAM AND ANY ILLNESS, INJURY OR DEATH RESULTING THEREFROM. I UNDERSTAND THAT THIS DOCUMENT IS A PROMISE NOT TO SUE AND A RELEASE OF AND INDEMNIFICATION FOR ALL CLAIMS. IF SIGNING ON BEHALF OF MINOR: I ALSO UNDERSTAND THAT THIS AGREEMENT IS MADE ON BEHALF OF MY MINOR CHILD(REN) AND/OR LEGAL WARDS AND I REPRESENT AND WARRANT TO THE BARRACUDAS THAT I HAVE FULL AUTHORITY TO SIGN THIS AGREEMENT ON BEHALF OF SUCH MINOR(S).
